State of Play: Antitrust and the NCAA

Please join us for this spirited discussion of antitrust and the NCAA. All three of our all-star panelists participated in 2018’s landmark trial in In re: NCAA Grant-in-Aid Cap Antitrust Litigation (NCAA GIA), in which a class of NCAA Division 1 basketball and football players brought suit under the Sherman Act to challenge NCAA rules limiting the level of financial aid and benefits that student-athletes may receive. In addition to the NCAA’s pending cert petition to the Supreme Court in NCAA GIA, the panel will also discuss the emerging market for student athletes to earn money in connection with their name, image, and likeness (NIL). This discussion will include the NIL laws that have been passed by California and other states, the NCAA’s ongoing NIL rulemaking process, potential federal NIL legislation, how to determine athletes’ economic value in the NIL market, and the antitrust implications of the evolving NIL landscape—particularly with regard to individual vs. group licensing.
